2. Data processed, purpose and legal basis

The data processed depends on how you get in touch:

Contact form

Name, email address, company — where provided —, type of service requested, message content and your acceptance of this privacy policy.

The purpose is to answer your enquiry, assess a possible engagement and, where appropriate, manage the steps leading up to a professional relationship. The legal basis is the consent given by ticking the box on the form, under Article 6(1)(a) GDPR and, where the enquiry concerns a possible engagement, the pre-contractual measures requested by the data subject under Article 6(1)(b) GDPR.

The fields marked as required are necessary in order to reply. If they are not provided, the enquiry cannot be submitted or properly handled.

Email, telephone and WhatsApp

The identifying, contact, professional and project data you choose to provide.

The purpose is to handle the communication and, where applicable, to prepare or manage the professional relationship. The legal basis is the pre-contractual measures requested by you under Article 6(1)(b) GDPR, or the legitimate interest in responding to professional enquiries under Article 6(1)(f) GDPR.

By using WhatsApp you leave this website and access a third-party service. Any processing WhatsApp carries out as controller of its own platform is governed by its own terms and privacy policy.

Call bookings via Calendly

When booking a call, the following may be processed: name, email address, date and time of the meeting, time zone, answers included in the booking and any other information you choose to provide.

The purpose is to manage the appointment and its related communications. The legal basis is the pre-contractual measures requested by you under Article 6(1)(b) GDPR. Calendly provides the service as a processor on behalf of the controller, without prejudice to its own processing as described in its privacy policy.

Browsing and site security

The hosting provider may process technical data such as IP address, date and time of access, requested resource, browser, operating system and security logs.

The purpose is to serve the website, maintain its availability, prevent abuse and diagnose incidents. The legal basis is the legitimate interest in operating and protecting the site, under Article 6(1)(f) GDPR.

Data is not used for advertising, unsolicited marketing or profiling. No automated decisions producing legal or similarly significant effects are made.

3. Source of the data

Data comes directly from the data subject when using the form, writing, calling, contacting via WhatsApp or booking an appointment. Technical browsing data is generated automatically on accessing the site.

4. Retention

  • Enquiries that do not lead to a professional relationship are kept for a maximum of one year from the last contact, unless earlier erasure is requested or retention is necessary to bring, exercise or defend claims.
  • Where an enquiry leads to a professional relationship, data is kept for the duration of that relationship and, once ended, for the periods needed to comply with legal obligations and address possible liabilities.
  • Technical logs are kept only for as long as needed to provide and protect the service, resolve incidents and comply with applicable legal obligations, according to the hosting provider's configuration and retention periods.

Data is blocked or deleted once it is no longer necessary, unless a legal retention obligation applies.

5. Providers, recipients and international transfers

The following providers are used to deliver the service and may access personal data as processors:

  • Netlify, Inc., for hosting the site and receiving and managing form submissions.
  • Microsoft 365, for professional email.
  • Calendly, LLC, for call bookings.

Data is neither sold nor disclosed to third parties, except where legally required or where necessary to bring, exercise or defend claims.

Some providers or their sub-processors may process data outside the European Economic Area. Where applicable, transfers to the United States rely on the adequacy decision for the EU-US Data Privacy Framework for participating entities and, additionally or alternatively, on the European Commission's standard contractual clauses or other valid safeguards under the GDPR.

6. Google Fonts

The site's typefaces are loaded from Google Fonts. In doing so, the browser connects to Google servers and transmits technical data, including the IP address, in order to download the necessary files. The purpose is to present the site with a consistent appearance and the legal basis is the legitimate interest in providing adequate rendering, under Article 6(1)(f) GDPR.

Google may process data outside the European Economic Area in accordance with the transfer mechanisms described in its privacy policy. This connection can be avoided in a future version by self-hosting the typefaces.

7. Cookies and similar technologies

This site uses no first-party analytics, tracking or advertising cookies.

Browser local storage is used for a single technical purpose: to remember that you have dismissed the notice offering the site in the other language. That value stays in your browser, identifies no one and is not sent to any server.

Links to Calendly, WhatsApp, LinkedIn, Malt, Credly and other external services lead to third-party sites. Those services may use cookies or other technologies under their own policies once you access them.

Should analytics, advertising or other non-essential technologies be added in the future, this policy and, where necessary, the consent mechanism will be updated before they are activated.

8. Your rights

You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability by writing to facundo@facundocorbalan.com, stating which right you wish to exercise. Additional information may be requested only where necessary to verify your identity.

Where processing is based on consent, you may withdraw it at any time by the same means. Withdrawal does not affect the lawfulness of processing carried out beforehand.

You may also lodge a complaint with the Spanish Data Protection Agency at www.aepd.es.

9. Security

Reasonable technical and organisational measures are applied to protect data against loss, alteration, unauthorised access or disclosure. That said, no system connected to the internet can guarantee absolute security.

10. Changes to this policy

This policy may be updated to reflect legal or technical changes, or changes in the services used. The version in force is always the one published on this page.

This policy governs only the processing related to the website and its contact channels. Where Facundo Corbalán accesses personal data on behalf of a client while providing professional services, he acts as a processor and that relationship must be governed by the corresponding contract under Article 28 GDPR.
